Not legal advice, and not a law firm
LeadCompliant is an independent publisher of compliance information. We are not a law firm, we do not practice law, and nothing on this site is legal advice. Reading our content, using our tools, or buying our kit does not create an attorney-client relationship of any kind. TCPA and state telemarketing law are heavily litigated and fact-specific. For advice about your campaigns, your consent language, or a demand letter you have received, consult a licensed TCPA attorney.
Scores, audits, and risk assessments are informational
Our compliance checker, TCPA score, risk assessment, and audit checklists evaluate only the information you enter, against general criteria we publish. A favorable score is not a legal determination that your program complies with any law, and it is not a defense in litigation or an enforcement action. An unfavorable score is not a finding that you have violated anything. These tools exist to help you spot topics worth reviewing with counsel.
No guarantee of any outcome
LeadCompliant does not guarantee that using our content, templates, SOPs, or kit will prevent consumer complaints, demand letters, lawsuits, class actions, regulatory penalties, or carrier blocking. No publisher can promise that. Compliance outcomes depend on your actual practices, your vendors, and decisions made by courts and regulators, none of which we control.
Penalty figures and calculator outputs are reference points
Figures such as statutory damages of $500 to $1,500 per violation come from the text of the TCPA, and our calculators combine numbers like these with the volumes you enter to produce planning estimates. Those outputs are not predictions of liability, settlement values, or what any court would award. Actual exposure depends on the facts, the jurisdiction, and rulings we cannot foresee.
Templates are self-help drafts
Consent language, SOPs, response letters, and other templates on this site are general-purpose drafts you adapt and use at your own discretion. They are starting points, not documents tailored to your business. Before you rely on one in a dispute or file anything with a regulator, have it reviewed by your attorney. We never respond to a complaint, a subpoena, or a regulator on your behalf.
Rules vary and change
Federal telemarketing rules shift with FCC and FTC actions and court decisions, and state mini-TCPA statutes add their own requirements that differ state by state. Content on this site may not reflect the most recent change that applies to you. Before you rely on anything here, confirm the current rule in the statute text, the FCC and FTC published materials, and your state's law. If this site and a governing source ever disagree, the source is correct.
About the National Do Not Call Registry
The National Do Not Call Registry is operated by the FTC, and it is the only authoritative source for registry status. Our do-not-call related tools and guides are informational aids. They do not query the live registry, and they are not a substitute for the scrubbing, subscription, and recordkeeping obligations that apply to sellers and telemarketers.
We are an independent publisher
LeadCompliant is an independent business. We are not affiliated with, endorsed by, or authorized to act on behalf of the FCC, the FTC, any state attorney general, or any other government body. Names of agencies, statutes, and programs are used only to help you identify the correct authority behind a rule.
External links
Where we link to statutes, agency pages, and other outside sites, we do so to point you to the authority behind a rule. We do not control those sites and are not responsible for their content or availability. A link is not an endorsement, and an outside page may change after we reference it.
